How the rate is set

Under Texas Finance Code §304.003, the Texas Consumer Credit Commissioner sets the post-judgment rate for each month from the prime rate published by the Board of Governors of the Federal Reserve System, but never less than 5% or more than 15% a year. The rates below are the published post-judgment rates, floor and cap already applied.

The rate for the month of rendition stays fixed for the life of the judgment, and the interest compounds annually (§304.006).

A judgment on a contract that provides for interest earns the contract rate instead, capped at 18% a year (§304.002). This table does not apply to those judgments.

Months covered

The table starts in January 2005, the first month JudgmentVault calculates. Judgments rendered earlier follow an older rate rule. A new month is added after the OCCC publishes it, so the most recent published month can briefly be missing here.
